§ 1 Item
These general terms and conditions regulate the legal framework for the use of the website http://www.conelly-design.com or conelly-design.de and the contractual relationships between the buyer - hereinafter referred to as "customer" - and the seller Conelly-Design, owner Lars Lewitzke, Alte Bahnhofstr. 16, 25992 List a. § 2 Conclusion of contract
1. Offers and representations on the Conelly-Design website are subject to change.
2. Conelly-Design will confirm receipt of the customer's order electronically. The confirmation does not result in the conclusion of the contract.
3. By submitting the shopping cart, the customer places a binding order. The customer is bound to his order for 6 weeks unless Conelly-Design rejects the order before this time has expired. The presentation of the products in the online shop does not represent a legally binding offer, but a non-binding sample proposal. The confirmation of receipt of the order follows immediately after the order has been sent and does not yet represent acceptance of the contract. We can confirm your order by sending an order confirmation by e-mail -Mail or by delivering the goods within 5 days. The contract is concluded exclusively in German.
4. Orders from other countries may have different shipping costs, these will be communicated on request.
5. The order is subject to the availability of the goods. If the goods are not available, the customer will be informed immediately and any consideration already paid will be reimbursed. The goods are only delivered in normal household quantities.
6. An order is only possible for adults (= from 18 years of age).
§ 3 Prices & Methods of payment
1. The indicated prices apply. All prices are retail prices and include statutory VAT. Shipping costs are included from an order value of EURO 1,500.00.

- by credit card (only via PayPal)
- by invoice (transfer after receipt of order)
- in advance (by bank transfer)

§ 4 Delivery / retention of title
1. Unless otherwise agreed, delivery is made from stock to the delivery address specified by the customer.
3. Conelly-Design will inform you immediately about delays in delivery.
4. Ownership of the delivered goods is only transferred to the customer once all of the seller's claims against the customer have been met.
5. Conelly Design delivers from within 3-12 weeks. For island deliveries, longer delivery times may occur. Further information on delivery can also be found in our FAQs.
§ 5 Cancellation policy
1. Conelly-Design, owner Lars Lewitzke only concludes contracts for the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. Therefore, there is no right of withdrawal according to Section 312 g Paragraph 2 No. 1 BGB.
2. The following applies to orders for samples or products that are not individually manufactured:
You can cancel your contract declaration within 14 days without Statement of reasons in text form (e.g. letter, fax, e-mail). The period begins after receipt of this instruction in text form, but not before the conclusion of the contract and also not before fulfillment of our information obligations according to Article 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB as well as our obligations according to § 312g paragraph 1 sentence 1 BGB in connection with Article 246 § 3 EGBGB. Revocation consequences
In the event of an effective revocation, the services received by both parties must be returned and any benefits (e.g. interest) surrendered. If you cannot return or hand over the received service and benefits (e.g. advantages of use) or only partially or only in a deteriorated condition, you must compensate us for the value in this respect. This can mean that you still have to fulfill the contractual payment obligations for the period up to the revocation. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your cancellation notice, for us when we receive it.
Special Notes
Your right of revocation expires prematurely if the contract has been completely fulfilled by both parties at your express request before your exercised your right of withdrawal.

§ 6 Warranty and Liability
1. Legal regulations apply. The limitation period for statutory claims for defects is 2 years.
2. If the items delivered have obvious material or manufacturing defects or damage in transit, please report such defects to Conelly-Design as soon as possible. There is no obligation on the part of the customer to do this and it is also not a prerequisite for the assertion of your claims. However, otherwise Conelly-Design cannot assert any claims against the carrier. Compliance with the above provision does not affect your statutory rights as a private consumer.
3. Conelly-Design does not guarantee that the Internet address http://www.conelly-design.com or http://www.conelly-design.de can be reached at any time and is error-free. This applies in particular if access to the offer is caused by disruptions that are beyond Conelly-Design's sphere of influence.
4. If there is a defect in the purchased item for which Conelly-Design is responsible, the customer can demand supplementary performance (remedy of defects) in accordance with the statutory provisions.
5. Irrespective of the legal basis, Conelly-Design shall pay damages in full in the event of intent and gross negligence, in the absence of a guaranteed property in the amount of the typical and foreseeable damage that should have been prevented by the property guarantee. In all other cases, liability is excluded unless otherwise regulated below. Conelly-Design is only liable for damage caused to the delivery item itself; in particular, Conelly-Design is not liable for lost profits or other financial losses. Insofar as the liability of Conelly-Design is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents. The above limitations of liability do not apply if there is personal injury or if the customer is entitled to claims under Sections 1 and 4 of the Product Liability Act.
6. Conelly design products are individual and mostly hand-assembled products. Small irregularities such as scratches or traces of polishing, as well as length and width tolerances are natural conditions of the manufacturing process and are not grounds for complaint. Differences in color are also possible due to the material. Such circumstances, which are based on the natural properties of the material or the manufacturing process, do not constitute a defect and do not entitle the assertion of warranty rights.
§ 7 data protection
1. Conelly-Design treats the personal data of the customer and the users of Conelly-Design confidentially and only makes this available to third parties insofar as this is permitted by data protection law or the customer consents to this.
2. Conelly-Design points out that the customer's personal data is processed electronically. The data will only be used to execute the contract, unless otherwise agreed. We save the text of the contract and send you the order data by e-mail. The terms and conditions can be viewed at any time. For security reasons, your order data is no longer accessible via the Internet.
4. If the contract is terminated, the customer's personal data will be deleted with the effectiveness of the termination, unless their further storage is legally required or separately agreed.

§ 8 Final Provisions
1. Conelly-Design reserves the right to change the offer and/or these terms and conditions at any time.
2. It is only the law of the Federal Republic of Germany. The application of UN sales law is excluded.
3. The customer is only entitled to set off if his counterclaims have been legally established or recognized by Conelly-Design. In addition, the customer is only authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.
